THINGS JUSTICE JOHN TSOHO MUST KNOW BEFORE PASSING JUDGEMENT ON NNAMDI KANU ON 29TH JANUARY 2016

We are the Indigenous People of Biafra. Nnamdi Kanu is our leader, and he is the director of Radio Biafra and Biafra TV.  Nnamdi Kanu is a human right activist and a freedom fighter. He is fighting for the freedom and Self-determination of Biafrans. He was illegally arrested by the DSS for fighting for the freedom and self-determination of his people, the Biafrans, Via broadcasting on radio Biafra. This point should be clear to advocates of treason charge on Him. The law on freedom of speech has not been abrogated in the Nigerian Constitution and arresting and charging a citizen for treason just because he expressed his feelings and desires as enshrined in the constitution amounts to an infringement on the fundamental human rights of the citizen. And in this case the fundamental human rights of Nnamdi Kanu is grossly infringed upon. That is why for two months, Buhari and his DSS were still at a loss as to what offence to charge him for which the Judge said  "From the available facts before the court, it is clear that the DSS either does not have enough materials to prosecute the applicant in a law court or yet to make up their mind on prosecution. Which means as at the time the DSS charged Kanu to they don't have any case against him or do not know what to charge him of. What a shame that the country's highest security outfit wants to bend the country's constitution and law to manufacture a law meant for just one man, because, in the history of Nigeria criminal justice system, no citizen has ever been charged with treason just for expressing and exercising his rights of freedom of speech.
The right of self-determination of Indigenous Peoples is a fundamental principle in international law. It is embodied in the Charter of the United Nations and the International Covenant on Civil and Political Rights and the International Covenant on Economic, Social and Cultural Rights. Common Article 1, paragraph 1 of these Covenants provides that:
"All peoples have the rights of self-determination. By virtue of that right they freely determine their political status and freely pursue their economic, social and cultural development."
The right of self-determination has also been recognized in other international and regional human rights instruments such as Part VII of the Helsinki Final Act 1975 and Article 20 of the African Charter of Human and Peoples' Rights as well as the Declaration on the Granting of Independence to Colonial Territories and Peoples. It has been endorsed by the International Court of Justice. Furthermore, the scope and content of the right of self- determination has been elaborated upon by the United Nations Human Rights Committee and Committee on the Elimination of Racial Discrimination as well as international jurists and human rights experts.

The treasonable felony charge against Nnamdi Kanu by the federal government of Nigeria is a slit on the right of Indigenous People in the UN charter and constitution of the Federal Republic of Nigeria. It does not hold water, because he is fighting for the self-determination of Biafrans in accordance with international law using the only weapon of freedom of speech.
We don't want to be in the same country with people we don't share the same mentality, religion, culture, language, accent or value system with.
The several mentions of sharia in the constitution in the face of Section 10 of the same so-called constitution that prohibits adoption of state religion, has left a leeway for several states in the far north to impose sharia, which in turn activated Boko Haram, which owes it an obligation to their faith to kill the 'infidel', a category to which we the Biafrans fall, in their warped estimation.
It is not a hidden truth that this "amalgamation contract" aimed at integrating Biafrans with Hausa Fulani and Yoruba within 100 years have never worked, and will never work. This amalgamation exercise which was made by Frederick John Dealtry Lugard in 1914 has long expired since 2014. "This simply implies that the component parts of what made up the Nigeria state can now go their separate ways. In other words, Nigeria is no longer a legal entity having expired since 1914.
From the forgoing, it is clear that, Nnnamdi Kanu the leader of the Indigenous People of Biafra, Director of Radio Biafra and Biafra TV, did not commit the treasonable felony charges levelled against him by Nigeria government. I therefore urge honourable JUSTICE JOHN TSOHO to ensure that, come Friday 29th January 2016, his judgement should be devoid of interference from President Muhammadu Buhari to pervert justice. The entire world is watching and your integrity is at stake. Do not let your years of meritorious service be tarnished by the evil desire of the illiterate president of Nigeria.
